Ownership; Trademarks; Modifications to Offers:

By using the Jackpot Jamboree Club services and any offers provided through it, you agree that Jackpot Jamboree or its partners will retain all legal rights, titles, and interests, including any intellectual property rights. You are not allowed to alter or modify any offers made through the Jackpot Jamboree Club service, and you must not remove, obscure, or alter any proprietary rights notices (such as copyright or trademark notices) affixed to the Jackpot Jamboree Club services or offers. Unless expressly authorized by a partner, you agree not to use any Trademark, service mark, trade name, or logo (“Trademarks”) of any entity in a way that may cause confusion about Trademark ownership or be detrimental to the goodwill of such Trademarks.

Disclaimer of Warranties:

The Jackpot Jamboree Club service is provided “as is” and “as available,” and Jackpot Jamboree provides no warranties, express or implied, regarding the service. This includes but is not limited to any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Factors beyond Jackpot Jamboree’s control, such as mobile carrier network speed and internet performance, may affect the service’s performance, and Jackpot Jamboree is not responsible for any acts beyond its control.

Limitation of Liability:

Under no circumstances shall Jackpot Jamboree, its officers, directors, employees, or agents be liable to you for any damages whatsoever arising from your use of the Jackpot Jamboree Club service. This includes direct, indirect, incidental, consequential, exemplary, or special damages, even if advised of the possibility of such damages. If applicable law prohibits any disclaimer or limitation on damages or liability set forth herein in a particular circumstance, Jackpot Jamboree shall be entitled to the maximum disclaimers and/or limitations on damages and liability available by such applicable law in that particular circumstance. However, in no event shall Jackpot Jamboree’s liability for damages arising under these Terms of Use or your use of the Jackpot Jamboree Club service exceed US $500.

Indemnity:

You agree to indemnify and hold each Company party harmless from any claim or demand, and any damages, costs, or expenses arising in connection with such claim or demand, including reasonable attorneys’ fees and costs, made by any other party due to or arising out of your breach of this agreement or the documents it incorporates by reference, or your violation of any law or the right of another party.

Governing Law; Venue:

This agreement and its validity, construction, and performance will be governed in all respects by the laws of the state of Texas, without regard to its choice of law provisions. You irrevocably agree to accept the exclusive personal jurisdiction and waive any objections to the venue of such courts.
