When you use the Jackpot Jamboree service, you (“You”) are bound by the following Terms of Service (“TOS”). These TOS may be updated by Jackpot Jamboree at their discretion, and you will be notified of any changes via email. By logging into our system, you indicate your acceptance of these Terms of Service.

 

PRODUCTS & SERVICE DESCRIPTION:

 

Jackpot Jamboree offers an innovative service that allows the transmission of information through SMS text messages via an easy-to-use website (the “Service”). By using the Service, you agree to receive specific communications from Jackpot Jamboree via email, which may include service announcements and administrative messages related to your membership. Any new features that enhance or expand the current Service will also be governed by these TOS. Please note that the Service is provided on an “AS-IS” basis, and you are responsible for any additional fees, such as internet service provider or airtime charges, necessary to access it. Additionally, you are responsible for providing the required equipment to use the Service.

 

JACKPOT JAMBOREE PRIVACY POLICY:

 

To set up your account, you must provide certain information to Jackpot Jamboree. Rest assured that your information will never be disclosed to anyone without your prior approval, except when required by law. As part of the service, Jackpot Jamboree collects the phone numbers of prospective members accessing information via text messages (SMS), and these phone numbers will never be shared.

 

MEMBER ACCOUNT, PASSWORD, AND SECURITY:

 

Upon completing the registration process, you will receive a password and account designation. It is your responsibility to keep your password and account information confidential, and you are fully liable for all activities that occur under your account. If you suspect any unauthorized use or security breach, you must notify Jackpot Jamboree immediately. Failure to comply may result in losses or damages for which Jackpot Jamboree is not responsible.

 

MEMBER CONDUCT:

 

You acknowledge that Jackpot Jamboree may access, preserve, and disclose your account information and content if required by law or in good faith belief to protect the rights, property, or safety of Jackpot Jamboree, its users, and the public. The technical processing and transmission of the Service may require changes to meet the technical requirements of connecting networks or devices. The materials provided on the Service are protected by usage rules set by Jackpot Jamboree, and any unauthorized reproduction or distribution is strictly prohibited.

 

INDEMNITY:

 

By subscribing to Jackpot Jamboree or using its services, you agree to defend, indemnify, and hold Jackpot Jamboree, its officers, agents, and employees harmless from any claim, complaint, demand, or lawsuit, including reasonable attorneys’ fees, arising from your subscription or use of the services.

 

NO RESALE OF SERVICE:

 

The Jackpot Jamboree service is non-transferable, and you may not reproduce, duplicate, sell, trade, resell, or exploit any portion of the Service for commercial purposes.

 

MODIFICATIONS TO SERVICE:

 

Jackpot Jamboree reserves the right to modify or discontinue the Service, either temporarily or permanently, with or without notice.

 

TERMINATION:

 

Jackpot Jamboree may terminate your account and access to the Service under certain circumstances and without prior notice, including breaches of the TOS, requests by law enforcement or government agencies, discontinuance of the Service, or fraudulent/illegal activities. Termination may involve deleting your password and all related information, barring further use of the Service.

 

JACKPOT JAMBOREE PROPRIETARY RIGHTS:

 

The Service and the associated software contain proprietary and confidential information protected by intellectual property laws. You agree not to modify, rent, sell, distribute, or create derivative works based on the Service or the Software, except as expressly authorized by Jackpot Jamboree.

 

DISCLAIMER OF WARRANTIES:

 

Your use of the Service is at your sole risk, and Jackpot Jamboree expressly disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Jackpot Jamboree makes no warranty regarding uninterrupted, timely, secure, or error-free Service, accurate results, or correction of software errors. If you have an epileptic condition, consult your physician before using the Service, as it may induce seizures in some users.

 

LIMITATION OF LIABILITY:

 

Jackpot Jamboree shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the Service, including the cost of substitute goods and services.

 

EXCLUSIONS AND LIMITATIONS:

 

Certain jurisdictions may not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages, in which case some of the above limitations may not apply to you.

 

NOTICE:

 

Jackpot Jamboree may provide you with notices, including changes to the TOS, through email, regular mail, or postings on the Service.

 

TRADEMARK INFORMATION:

 

You may use Jackpot Jamboree’s trademarks on advertising and marketing campaigns with permission from Jackpot Jamboree.

 

GENERAL INFORMATION:

 

The TOS constitute the entire agreement between you and Jackpot Jamboree, governing your use of the Service and superseding any prior agreements. The TOS and your relationship with Jackpot Jamboree are governed by the laws of the State of Texas, with exclusive jurisdiction in Texas courts. The failure to exercise or enforce any right or provision of the TOS does not constitute a waiver, and if any provision is found invalid, the other provisions remain in effect. Your Jackpot Jamboree account is non-transferable, and any rights to it terminate upon your death. Claims or actions related to the Service must be filed within one year after the claim arises. Section titles in the TOS are for convenience and have no legal effect.
